Abstract

service to her husband, highlighting its importance in understanding marital rights and duties and in achieving family stability. It is considered one of the contemporary fiqh topics that requires clarification of its rulings and the differences among schools of thought. The research aims to examine the concept of service, its legitimacy, the impact of custom (،urf) on legal rulings, and the rights of both spouses, through a comparative fiqh analysis of the four Sunni schools as well as the Zaydi and Imami schools. The study relies on primary sources, authentic references, and established legal evidences.

Three complementary methodologies were adopted: the deductive method to derive the most relevant rulings, the comparative method to highlight agreements and differences, and the inductive method to survey the opinions and evidences of jurists. The research is structured into three sections: (1) the definition of service linguistically and technically, and its ruling in Islamic law; (2) the role of custom in determining service, its relation to Sharia, and the position of Yemeni law; and (3) marital rights in Islamic jurisprudence.

The study concludes that the majority of jurists do not obligate wives to serve their husbands, considering it part of good marital conduct. It also shows that custom plays a significant role in defining service according to living conditions, in line with Sharia objectives of fostering affection and mercy between spouses.

Abstract

This study analyzes the economic opportunities and risks associated with Yemen's involvement in China's Belt and Road Initiative, focusing on Yemen's position within the initiative and how China utilizes economic and investment tools to achieve strategic influence in the region. It assesses whether the initiative represents economic development or an "economic constraint" that threatens sovereignty and deepens dependency. The study employs a descriptive-analytical approach to identify and analyze opportunities and risks, evaluate their potential economic and strategic implications, and considers national interest. The study's significance lies in its contribution to the academic literature on the Belt and Road Initiative by analyzing the central issue of "opportunities versus risks" within the Yemeni context. It proposes an innovative analytical model that allows for an analysis of how the project can simultaneously be both an opportunity and a threat, enabling a comprehensive understanding and analysis of the initiative's multifaceted impacts. This will help Yemeni decision-makers grasp the opportunities and risks before entering into strategic partnerships.

The study concluded that Yemen's strategic importance and natural resources make it a focus of interest for China, which pursues a policy of economic dominance through the Belt and Road Initiative investments. Despite the cooperative slogans, the initiative conceals purely economic objectives, as loans and projects are used as tools for indirect dominance, which portends new forms of dependency. Many of the initiative's projects in different countries have been characterized as unsustainable. The study concluded that the Belt and Road Initiative will not succeed in Yemen unless it is designed in accordance with Yemeni national priorities, ensuring the preservation of economic and political sovereignty, and identifying strategic projects that serve the Yemeni economy, thus preventing the relationship with China from turning into economic dependency or political influence. The study emphasizes that the success of the initiative in Yemen requires adopting a conscious negotiating policy that ensures a balanced distribution of benefits and the achievement of sustainable development.

Abstract

This study aims to examine the methodology of the scholar Muhammad bin Ahmed Al-Ahdal in presenting his jurisprudential fatwas in response to questions. His responses were notably diverse. He would either provide a comprehensive answer followed by jurists' citations or present the scholars' opinions directly before offering his own commentary. For controversial issues, he cited opinions from established schools of thought—Zaidi, Hanafi, Maliki, and Hanbali—discussing and deriving rulings from them. His citations were marked by precision and scholarly integrity, presented verbatim, as summaries, or as essential points. When questioned about a Quranic verse or hadith, he referenced specialized works in exegesis, hadith commentary, and source criticism. His frequent referencing of various juristic opinions demonstrates his extensive knowledge of Sharia, auxiliary sciences, and the works of preceding scholars. Al-Ahdal excelled in both ifta (issuing fatwas) and authorship, often reviewing, correcting, and refuting the fatwas of his contemporaries. This research underscores the importance of primary sources, offering a rigorous scholarly methodology for studying jurisprudential issues and highlighting Yemen's own rich legal heritage. The researcher illustrated each step of the methodology of Sheikh Muhammad ibn Ahmad al-Ahdal in his fatwas with a practical example. This process included documenting the sources of Qur'anic verses and hadiths, attributing scholarly opinions to their respective authors, and explaining certain terms. Furthermore, the study aimed to provide a concise biography of Sheikh al-Ahdal, covering his birth, upbringing, most prominent teachers, students, and major works. The research concludes with the principal findings and recommendations.

Abstract

This research aims to examine the problem of stopping the implementation of a negative administrative decision and the dispute that has been raised regarding it between jurisprudence and the judiciary. The research also deals with the implementation of the judicial ruling issued to cancel the negative decision, and an explanation of whether the ruling achieves the required legal effect in itself, or whether the administration must intervene, and a statement of the position of the comparative administrative judiciary. From that, and comparing that with the position of the Yemeni judiciary. The research relied on the descriptive and analytical approach to the legal texts related to the subject in light of jurisprudential theories and by referring to judicial rulings, in addition to using the comparative approach, in order to compare what the administrative judiciary in the French system has reached with the Egyptian judiciary in the subject of the study, with the aim of benefiting from that in the system. Yemeni. The study reached a number of results, the most important of which is the permissibility of halting the implementation of a negative administrative decision if the legal conditions for that are met. The study also concluded that implementing the judicial ruling issued to cancel the negative decision requires the issuance of a positive administrative decision by the administration that refused to issue this decision when the concerned party approached it. Among the most important recommendations presented by the study is the call on the Yemeni legislator to regulate the procedures for appealing administrative decisions in general (negative and positive), including regulating the suspension of their implementation, and explicitly stipulating that it is permissible to halt the implementation of a negative administrative decision if its implementation results in irreparable damages. The study also recommended expanding the judge’s powers. Administrative in directing orders to the administration, as well as imposing a threatening fine on the administration when it refrains from implementing the ruling, and benefiting from the experience of the French system in this regard.

Abstract

International conventions have given paramount importance to prisoners' health rights, recognizing their crucial role in rehabilitating and reforming prisoners, paving the way for their reintegration into society as productive members. This has influenced the evolution of penal philosophy in national legislation, including Yemeni law, which has strived to humanize its provisions. All of this has been of great significance in establishing the preservation of human dignity for this group, particularly in the crucial area of healthcare, both internationally and nationally.

Therefore, this study aims to examine prisoners' health rights according to international conventions, using Yemeni legislation as a comparative model, and to identify the mechanisms for ensuring respect for prisoners' rights in international and Yemeni practice. The study focuses on how to address the exceptional global pandemic of COVID-19, which posed the greatest and most serious threat to all detainees and prisoners.

Hence, the central problem of this study is the need to delve deeply into the extent of international and national attention given to preserving and protecting prisoners' health rights. This is what we sought to achieve by scrutinizing international and national (Yemeni) mechanisms.

In pursuit of this, we adopted a descriptive and analytical approach by studying and analyzing legal texts in various international conventions and in the provisions of the Yemeni Prisons Organization Law, and through comparison between them, we arrived at the conclusions and recommendations we reached, all of which emphasize the necessity of adhering to all means of protection and health care guaranteed to the prisoner internationally and nationally.

Abstract

This study aimed to develop the communication skills of children with autism spectrum disorder in the Capital Secretariat of Sana'a. This was achieved through the following objectives: 1. Identifying the level of communication impairment among children with autism spectrum. 2. Enhancing their communication skills by training them to interact with others. 3. Recognizing the importance of training them in social communication through daily activities, such as group play and social behavior, to improve their communication simply and appealingly. The researcher employed a descriptive approach and utilized a communication behavior scale developed by the researcher. The scale consists of (30) items distributed across three dimensions (the verbal-communicative, non-verbal-gestural, and social dimensions), after being reviewed by a panel of experts to establish its validity and reliability before its application. The study sample consisted of (193) children, aged between (6-9) years, receiving training at special education centers in Sana'a. The training lasted five months. Results showed that the children in the research sample acquired communication skills, such as greeting others, waving, playing in a group, naming toys, and answering the question, "What is your name?"

Abstract

This study aims to critically evaluate the scholarly editing of Al-Ghusoon al-Miyasa through a structured methodological approach combining descriptive, analytical, and critical methods. The descriptive method was used to assess the editor’s introduction and editorial approach; the analytical method compared the edited text with two manuscript copies and original sources; and the critical method identified methodological flaws and their impact on textual integrity.

The research is divided into two main sections: the first introduces the author, the book, and the editor; the second evaluates the editor’s performance across four thematic areas. The findings revealed major editorial issues, including reliance on a single manuscript, poor textual organization, lack of scholarly annotation, biographical inaccuracies, misattribution of sources, and conceptual errors in legal and theological content.

The study concludes with actionable recommendations: thorough collation of available manuscripts, adherence to editorial standards, inclusion of scholarly commentary, accurate biographical referencing, development of a methodological guide, digital collation tools, collaborative editing, and revision of academic publishing criteria. This research contributes to improving the quality and reliability of classical text editing in Islamic studies.

Abstract

This study aimed to investigate the role of strategic thinking dimensions (future vision, organized thinking, opportunity thinking, creative thinking, timely thinking) in achieving a competitive advantage in the private universities in the capital, Sana'a. The descriptive analytical method was used and a questionnaire was used as the main tool for data collection in this survey study. The population of the study consisted of the employees of senior leadership, including (rectors, deputies, deans, vice deans, general managers, department directors, and heads of academic and administrative departments in the Yemeni private universities in the capital Sana’a during 2025l. The study sample comprised of (335) participants. The questionnaire was distributed to all (250) participants, (242) of which were retrieved and were valid for data analysis. The data were processed and analyzed using (SPSS) program and Partial Least Square-structural Equation Modeling (PLS-SEM).The results revealed that there is a positive role of strategic thinking in achieving a competitive advantage in the Yemeni private universities. The results also found that the leaders of the private Yemeni universities have much interest in strategic thinking and its dimensions by focusing on the future vision of private universities, organized thinking, opportunity thinking, creative thinking, and timely thinking. In light of the findings, the study concluded with certain recommendations, most notably, emphasizing the importance of enhancing the capabilities and skills of senior and middle leaders of Yemeni private universities in strategic thinking for its role in achieving the goals of private universities, which as a result achieving a competitive advantage.

Abstract

This study aimed to measure Yemeni consumer preferences for product strategies for local and foreign brands, using a survey approach and a questionnaire tool to collect data through a deliberate sample consisting of (410) individuals, who were divided into (205) individual consumers of local and foreign goods, and (205) individual consumers of local and foreign services, this is according to the criterion of exposure to advertisements of local and foreign brands.

The study reached several results, the most important of which are:

- There is a statistically significant difference in Yemeni consumer attitudes towards branded products, as a result of the difference in the brand identity of the product (local/foreign).

- There is a statistically significant difference in the degree of Yemeni consumer preference for the strategy of brand product attributes, as a result of the difference in the brand identity of the product (local/foreign).

- There is a statistically significant difference in the degree of Yemeni consumer preference for the self-identification strategy with brands, as a result of the difference in the brand identity of the product (local/foreign).

- There is a statistically significant difference in the degree of Yemeni consumer preference for the strategy of brand product appearance, as a result of the difference in the brand identity of the product (local/foreign).

- There is a statistically significant difference in the degree of Yemeni consumer preference for the brand personality strategy, as a result of the difference in the brand identity of the product (local/foreign).

The Essence of Mind in the Atheistic Perspective

Abstract

This study examined the scientific foundations upon which the atheistic perspective relies in explaining the nature of the mind, and evaluated its ability to provide an explanation for mental phenomena. The study aimed to review and examine the scientific evidence presented by the atheistic perspective through Darwinian theory, atomic theory, and contemporary empirical evidence. The study followed an analytical-critical methodology in examining this evidence. The study found that the atheistic perspective relies on evolutionary theory, which views the mind as a product of natural selection, and atomic theory, which reduces the mind to chemical and physical interactions, in addition to empirical evidence from neuroscience linking brain activity to mental states. However, the study revealed limitations in these explanations. Darwinian theory faces difficulties in explaining abstract mental capacities that transcend survival requirements, the structural complexity of the brain, and the evolutionary gap between humans and great apes. Atomic theory encounters problems in explaining the unity and coherence of conscious experience and the subjective nature of consciousness. The study concluded that scientific evidence does not exclusively support the materialistic atheistic perspective; rather, it indicates that the mind transcends what can be explained through purely material processes.

Abstract

This study aimed to identify the role of kindergarten teachers in enhancing the cultural identity of preschool children in the Capital Secretariat – Sana'a, in light of certain variables. The study employed the descriptive-analytical method. The study population consisted of all kindergarten teachers in preschool institutions operating in the Capital Secretariat of Sana'a during the academic year 2024/ 2025, totaling 665 teachers. The study sample comprised 189 kindergarten teachers. To achieve the objectives of the study, a questionnaire prepared by the researchers was used, and its psychometric properties were verified by establishing its validity and reliability. After confirming its suitability, it was administered to the study sample. The study reached several findings, as it revealed that kindergarten teachers play a vital role in enhancing the cultural identity of Yemeni children through three main dimensions: enhancing cultural identity through general culture, using teaching methods to strengthen the child's cultural identity, and developing cultural activities to contribute to building the child's personality and broadening their cultural experiences. The weighted means of these dimensions ranged between (4.49 – 4.38), which are considered very high according to the criterion adopted in the study. The results also confirmed the existence of statistically significant differences at the 0.05 significance level across the three study dimensions between public and private kindergarten teachers, in favor of public schools. On the other hand, no statistically significant differences were found at the 0.05 level in the three dimensions according to the teacher's age, educational qualification, or years of experience. Abstract

The study aims to understand the concept of the “one community and to clarify that the mission of the Messengers and the divine scriptures is to resolve divergence and eliminate it. It also explains that divergence after clear evidences arises from transgression, and that God guides to the truth that opponents have lost and does not allow it to be lost. The researcher employed the descriptive-analytical method, supported by the historical method.

The study is structured around three main axes:

l. Demonstrate the concept of the “one community”.

2. Understanding the role of the divine scriptures and messengers in resolving divergence in order to build humanity as a single community.

3. The renewal of divine guidance to clarify the true divine religion that opponents have lost, so that the community may be rebuilt as one.

The study concludes with several findings, most notably that the concept of the “one community” in the Qur’anic project of Sayyid Hussein Badr al-Din al-Houthi is not merely a description of a historical condition, but rather the fundamental purpose and ultimate objective of the heavenly messages, and that its essence lies in unity of purpose and methodology.

The project asserts that the function of the divine “Book” and the “clear proofs” is to decisively resolve divergence rather than to legitimize it, which contradicts approaches that view divergence as a natural outcome of multiple textual interpretations.

Moreover, the true origin of reprehensible divergence is identified as a deliberate and intentional act—namely, transgression (Transgression). The Qur’anic project also establishes the concept of “renewed divine guidance” as a fixed divine law, whereby divine providence intervenes to guide a group of believers to the truth over which divergence has arisen through guiding figures who represent an extension of prophetic authority

Abstract

This study aimed to explore the factors that senior translation students at Sana’a University perceive as the main causes of the difficulties they have in rendering metaphorical expressions in English economics texts into Arabic. To achieve this objective, the study employed a mixed-methods approach to the analysis of the data collected via a questionnaire administered to a randomly selected sample of 55 senior translation students enrolled in the Translation Dept. at the Faculty of Languages at Sana'a University. Statistical analysis of the data was then carried out using the Statistical Package for Social Sciences (SPSS). Results revealed that senior translation students believe that the difficulties they encounter when translating metaphors in English economic discourses into Arabic arise from a variety of factors, the main ones of which include cultural differences, students' low linguistic proficiency, divergences between the linguistic systems of Arabic and English, lack of necessary resources for translation of economic metaphors and limited exposure to these metaphors in genuine texts, students’ unawareness of the appropriate translation strategies for rendering the target metaphors, curriculum-related factors, and finally other factors related to translation instruction and teaching. The study therefore recommends that metaphorical expressions in English economics texts and the appropriate strategies for rendering them into Arabic be integrated into translation instruction. It is also recommended that greater attention be given to translation courses by increasing the hours allocated to teaching and practicing translation between English and Arabic. This will certainly enable students to broaden their cultural knowledge, improve their linguistic proficiency, and enhance their translation skills.

Abstract

This study was aimed at examining digital transformation and its impact on the performance of human resources management (HRM) at Hayel Saeed Anam (HSA) Group (HQ) in Yemen. The study sample consisted of 164 employees at HSA Group. A quantitative approach was adopted using SPSS v21.0 to analyze the correlation and regression results.

The findings indicate that the independent variables—digital transformation components such as technological infrastructure, organizational culture, and transformational leadership—have a significant positive effect on HRM performance. The regression analysis explains 59.8% of the variation in HRM performance. A plausible interpretation of this positive result is that the selected independent variables are effective tools for enhancing HRM performance in that they can reshape HR functions and thus make them more effective and efficient.

Based on these findings, the study offers some practical recommendations for HSA Group should it wish to improve HRM performance and obtain a competitive status among other businesses.

The study also recommends that other industrial and commercial sectors in Yemen take into consideration these factors as they appear to have an immediate impact on HRM performance. Given the obvious limitations of the study, future research could pay closer attention to additional variables that may substantially enhance HRM performance as well as challenges that may undermine HRM practices.

Abstract

This study aimed to introduce the eminent scholar ('Allamah) Al-Hasan bin Ibrahim Al-Khatib, elucidate his academic standing and scholarly output, and analyze his methodology in his book of exegesis (Tafsir), titled "Nafā'is al-Jawāhir al-Ḥisān al-Bahiyyah fī Bayān Asrār Ma'ānī al-Āyāt al-Qur'āniyyah" (The Precious and Beautiful Gems on Elucidating the Secrets of the Meanings of the Qur'anic Verses), specifically through his interpretation of Sūrat Ṭāhā.

The study includes a brief biography of the author, an introduction to his book, and an explanation of his approach to Qur'anic interpretation. were employed the historical and descriptive-analytical methods. The study yielded several key findings, most notably: the accuracy of the book's title and its proper attribution to the author; the author’s adoption of a simple and accessible style while maintaining the profound depth of his content, which often challenges even eminent scholars. This is coupled with eloquent phrasing, strong expression, and profound knowledge, making the work highly suitable for specialists. The author successfully combined Exegesis based on Transmission (Tafsir bi al-Ma'thur) and Exegesis based on Sound Opinion (Tafsir bi al-Ra'y al-Mahmoud). Furthermore, the research confirmed that the author adhered to the Ash'ari theological creed and the Shafi'i school of jurisprudence (Madhhab). The researcher recommends conducting a comparative study between the methodology of Al-Hasan al-Khatib and that of his contemporary scholars in the field of Tafsir, and carrying out further researches on his approach to jurisprudential issues when interpreting verses of rulings (Ayat al-Ahkam).
